Give me trial by jury, says fallen footy star

FALLEN AFL star Wayne Carey has asked for a jury trial in the US in a clear sign he is determined to fight claims he assaulted two Miami police officers during a drunken night last year.

Carey has pleaded not guilty to three charges in the US through his high-powered celebrity lawyer, Richard Sharpstein. The charges carry a maximum 15 years in jail.

Mr Sharpstein has filed new documents in the Miami-Dade circuit court seeking a trial by jury when the case is heard in July.

Carey, 36, earned the ire of Miami judge Rosa Rodriguez this year when he failed to turn up for a court hearing following a mix-up over dates with his former lawyer.

He faces two charges of battery on a law enforcement officer and one of resisting an officer with violence after an allegedly wild night in a luxury Miami hotel in October.

He is accused of kicking one officer on the lower lip and elbowing another in the face.

They were called to Carey`s room following allegations he smashed a wine glass in girlfriend Kate Neilson`s face.

Mr Sharpstein yesterday demanded Florida prosecutors hand to the defence team any relevant information, including witness statements and police investigation reports.

The lawyer, who could not be reached yesterday, has said Carey would not accept any plea deal that resulted in time behind bars and he was determined to clear his name.
