CHARGES against dumped swimmer Nick D`Arcy were changed when he appeared in court this morning accused of hitting a fellow swimmer in the face at a Sydney nightclub.

Dressed in a dark grey suit, D`Arcy arrived at Sydney`s Downing Centre Local Court this morning to face charges of assaulting former swimmer Simon Cowley at the Loft last month.

He was accompanied by his father Justin and his legal team.

D`Arcy, 20, had been facing a charge each of assault and grievous bodily harm but due to a technicality they were withdrawn and a fresh charge of recklessly inflicting grievous bodily harm was laid.

Cowley suffered a broken jaw, broken nose, fractured eye socket, crushed cheekbone and fractured palate in the altercation.

Police will allege Darcy had consumed at least 16 drinks in under four hours before the incident.

Cowley has said he was only trying to shake D’Arcy’s hand and introduce himself when he was elbowed in the face.

DPP counsel Rhonda Ianna was today granted a change in D`Arcy`s bail conditions to prevent D`Arcy contacting fellow swimmer Stephanie Rice and four other unnamed witnesses.

D`Arcy spoke little in court, answering "yes" when the magistrate asked him to confirm his name and if he was aware of the single charge against him.

Deputy Chief Magistrate Paul Cloran adjourned the case until June 17.

Outside court, D`Arcy said he remained hopeful of a positive outcome in his appeal to the Court of Arbitration for Sport (CAS) to have his dumping from the Australian Olympic team for Beijing overturned.

D`arcy was kicked off the swim squad on Friday over the alleged assault.

"I`m still pretty optimistic about the outcome," he said.

He was still 100 per cent committed to competing in Beijing, he said.

D’Arcy’s solicitor said outside court that he had lodged an appeal with the CAS this morning.
