FUGITIVE Nai Yin Xue, suspected of murdering his wife in New Zealand and abandoning their three-year-old daughter in Melbourne, will appear in an Atlanta court today.

He was captured yesterday by six members of the Chinese community in Chamblee, a town on the outskirts of Atlanta, Georgia, and is currently being held in an Atlanta county jail.

New Zealand`s police liaison officer Sandra Manderson in Washington said Xue would be appearing in court today.

He had so far been charged with being a fugitive and being wanted in New Zealand.

Xue had been on the run since September last year, when his wife Anan Liu`s corpse was found in the boot of his car outside the family home in Auckland and his three-year-old daughter Qian Xun

Xue was found abandoned at Melbourne railway station before he flew to Los Angeles.

Tom Hession, lead investigator on the case from the United States Marshals office in Los Angeles, said Xue could be deported or go through an extradition process.

"He has some rights that he may invoke as far as wanting the full extradition, or he can waive it, or he can be deported,`` he said.

"It depends on New Zealand (Police), how they want to proceed ... they`re being talked to now, what their wishes and desires are, and that process we`ll agree to.``

"Either way he`ll end up back in New Zealand.``

Mr Hession said the timeline for Xue returning to New Zealand was "best case, within the week, worst case, months``.

New Zealand Police inquiry head Detective Senior Sergeant Simon Scott said details about Xue`s return to New Zealand would be worked through with US authorities in the next few days.

"Our information regarding extradition is that it`s approximately 45 days, but we are well ahead of the game regarding the extradition process,`` he told media.

Xue was captured by six American-Chinese men in Chamblee yesterday morning.

They jumped on him, tied his hands behind his back with his belt and pulled his trousers down to his ankles and knotted them so he could not run off.

His captors recognised him from a wanted photograph published in the Chinese World Journal newspaper.
