Nellis and Gardner, who managed De Vito`s career after the original Idol series in 2003, are seeking more than $500,000 in lost earnings.
Their lawsuit will allege that the singer made their professional roles "untenable".
De Vito has previously lodged a counter claim, stating that the management team was "negligent" in guiding her singing career.
The case is set to be heard by Justice Patricia Bergin.
